Key risks

All events are user‑run. You assume all risks related to offline interactions, including injury, harassment, fraud, or other harm.

Data

We collect email addresses and profile data for platform operation and optional marketing. Marketing is opt‑in and can be unsubscribed from at any time. Data is retained indefinitely for legitimate purposes unless deletion is requested.

Your role

You must behave lawfully and responsibly.
Events are limited to 10 participants maximum.
Speed‑dating events are strictly prohibited.

By using Migavibe, you agree to these Terms.

1. Introduction

Welcome to Migavibe, a platform designed for heterosexual singles seeking connections through user‑organized social events.

Migavibe is a technology platform only. We do not organize, host, manage, supervise, or attend events. All events are created and run independently by approved users (“Event Organizers”).

If you do not agree with these Terms, do not use the Platform.

2. Definitions

“We”, “Us”, “Platform”: Migamor GmbH and Migavibe
“You”, “User”: Any individual using the Platform
“Event Organizer”: A user approved to list events
“Content”: Profiles, text, photos, and event listings
“Services”: All platform features

3. Nature of Service – Platform Only

Migavibe connects users only.

You are solely responsible for:

Event logistics
Safety
Legal compliance
Participant conduct

Rules:

Events must be free of charge
No payments via the Platform
Maximum 10 participants per event (including organizer)
Speed‑dating events are prohibited

Violations may result in immediate removal and account termination.

4. User Safety and Responsibilities

Offline events carry inherent risks.

Organizer approval is not a background check and offers no guarantee.

5. Data Collection, Use, and Retention

We collect limited personal data for:

Data is retained indefinitely for legitimate business purposes unless deletion is requested.
Deletion requests are processed within 30 days, unless legal retention is required.

6. Event Organizers

Approval is discretionary and may be revoked at any time without notice or compensation.

Event Organizers must:

Respect the 10‑participant limit
Organize only free events
Comply with all applicable laws

7. Prohibited Conduct

You must not:

Post illegal, harmful, or misleading content
Misrepresent identity or age
Scrape data or misuse the Platform
Organize paid events
Exceed participant limits
Organize speed‑dating events
Discriminate against participants

Violations may result in termination and reporting to authorities.

8. Content Ownership and License

You retain ownership of your Content.

You grant Migavibe a worldwide, royalty‑free, perpetual license to use your Content for operating and promoting the Platform.

We may remove Content at our discretion.

9. Intellectual Property

All software, branding, and design belong to Migamor GmbH.

Unauthorized copying, modification, or reverse‑engineering is prohibited.

10. Disclaimers and Warranties

Services are provided “AS IS” and “AS AVAILABLE.”

We make no warranties regarding:

User reliability
Event safety or legality
Platform availability
Outcomes from use

You assume all risks.

11. Limitation of Liability

To the maximum extent permitted by law:

No liability for indirect or consequential damages
No liability for user conduct or offline events
Total direct liability is limited to CHF 100

Nothing limits liability where prohibited by mandatory EU consumer law.

12. Indemnification

You agree to indemnify Migamor GmbH against all claims arising from:

Your use of the Platform
Your Content or conduct
Events you organize or attend
Violations of these Terms or the law

13. Termination

You may delete your account at any time
We may suspend or terminate accounts at our discretion

Surviving obligations remain effective after termination.

14. Governing Law and Jurisdiction (EU)

These Terms are governed by the laws of Switzerland, excluding conflict‑of‑law rules, and in accordance with applicable European Union consumer protection laws.

If you are a consumer residing in the EU or EEA, you may bring legal proceedings in the courts of your country of residence or in Switzerland, as permitted by law.

Nothing in these Terms limits mandatory rights under EU or national consumer protection legislation.

15. General Provisions

Force majeure, severability, waiver, assignment, survival, and entire‑agreement clauses apply.

18. Limited Liability for User‑Organized Events

Migavibe is a technology platform only. Event Organizers act in their own name and responsibility.

Migavibe does not guarantee event safety, legality, or quality
Claims are waived except in cases of gross negligence or willful misconduct
Organizer data may be disclosed to authorities where legally required

To the maximum extent permitted by law, Migavibe’s total liability per event is limited to CHF 100, except where liability cannot be excluded under mandatory EU consumer law.
